Terms of Service

1.1 Creative Studios Division: Commercial photography services including real estate photography, portrait photography, event photography, and commercial photography.

1.2 Tactical Solutions Division: Professional drone services including infrastructure inspection, aerial surveys, aerial mapping, emergency response, and government contract services.

1.3 Service Scope: All services are provided subject to availability, weather conditions, FAA regulations, and project feasibility assessment.

2.1 Booking: Services must be booked through our official booking system or by written agreement. All bookings are subject to confirmation.

2.2 Payment Terms: Payment is accepted via Stripe (credit/debit cards) or PayPal. A deposit may be required to secure your booking.

2.3 Pricing: Quoted prices are valid for 30 days. Custom projects require individual quotes based on scope and requirements.

2.4 Late Payment: Invoices are due within 14 days unless otherwise agreed. Late payments may incur a 1.5% monthly interest charge.

3.1 Client Cancellation: Cancellations made more than 48 hours before scheduled service receive full refund of deposit. Cancellations within 48 hours forfeit deposit.

3.2 LNM1968 Cancellation: If we must cancel due to weather, equipment failure, or unforeseen circumstances, you will receive a full refund or option to reschedule at no additional cost.

3.3 Rescheduling: First reschedule is free if made 48+ hours in advance. Additional reschedules may incur a $50 administrative fee.

3.4 Weather Delays: Drone operations are weather-dependent and governed by FAA regulations. Weather-related postponements are not considered cancellations.

4.1 Copyright: LNM1968 LLC retains copyright to all photographs and video content produced. Clients receive usage rights as specified in their service agreement.

4.2 Standard License: Clients receive non-exclusive rights to use delivered media for personal or business purposes as agreed in writing.

4.3 Portfolio Use: LNM1968 reserves the right to use project images for portfolio, marketing, and promotional purposes unless expressly prohibited in writing.

4.4 Unauthorized Use: Reproduction, resale, or unauthorized distribution of delivered content is prohibited without written consent.

5.1 Standard Turnaround: Photography projects: 7-14 business days. Drone inspection projects: 5-10 business days. Rush services available for additional fee.

5.2 Delivery Method: Digital files delivered via secure cloud link or client portal. Physical media available upon request for additional fee.

5.3 File Retention: Project files retained for 90 days after delivery. Extended storage available by arrangement.

6.1 Insurance: LNM1968 maintains full commercial liability insurance and FAA Part 107 certification for all drone operations.

6.2 Limitation of Liability: Our liability is limited to the amount paid for services. We are not liable for indirect, consequential, or punitive damages.

6.3 Equipment Failure: While we maintain backup equipment, we are not liable for delays due to equipment failure or technical issues beyond our control.

6.4 Third-Party Access: Client is responsible for securing all necessary permissions, permits, and property access for scheduled services.

7.1 FAA Regulations: All drone operations comply with FAA Part 107 regulations and airspace restrictions.

7.2 Flight Restrictions: Operations may be restricted or prohibited in controlled airspace, near airports, or in restricted zones. We will notify you of any limitations.

7.3 Safety First: LNM1968 reserves the right to refuse or abort any flight deemed unsafe or in violation of FAA regulations.

8.1 Certifications: LNM1968 LLC is certified as a Disabled Veteran Business Enterprise (DVBE) and Service-Disabled Veteran-Owned Small Business (SDVOSB).

8.2 Government Projects: Government contracts are subject to additional terms as specified in individual contract agreements and applicable federal/state regulations.

8.3 Security Clearance: Security-sensitive projects require additional vetting and may have supplementary confidentiality requirements.

9.1 Client Information: We maintain strict confidentiality of client information and project details. See our Privacy Policy for details.

9.2 Sensitive Projects: Additional non-disclosure agreements (NDAs) available upon request for sensitive projects.

9.3 Data Security: All client data stored securely with encryption and regular backups.

10.1 Governing Law: These Terms are governed by the laws of the State of California.

10.2 Mediation: Any disputes shall first be attempted to be resolved through good-faith mediation.

10.3 Arbitration: If mediation fails, disputes will be resolved through binding arbitration in Northern California.

10.4 Legal Fees: Prevailing party in any dispute may be entitled to reasonable attorney fees.

11.1 Modifications: LNM1968 reserves the right to modify these Terms at any time. Updated Terms will be posted on our website with revision date.

11.2 Notification: Material changes will be communicated to active clients via email.

11.3 Acceptance: Continued use of services after Terms modification constitutes acceptance of new Terms.

12.1 SMS Opt-In: By providing your mobile phone number and opting into SMS communications, you consent to receive text messages from LNM1968 LLC. Message types may include marketing promotions, security alerts, customer care notifications, account notifications, two-factor authentication (2FA) codes, and service updates.

12.2 Message Frequency: Message frequency varies depending on the categories you subscribe to. Marketing messages may be sent up to 4 times per month. Security alerts and 2FA codes are sent as needed. You may receive additional messages related to your active service bookings or account activity.

12.3 Message & Data Rates: Standard message and data rates may apply according to your mobile carrier's plan. LNM1968 LLC does not charge for SMS messages, but your carrier may.

12.4 Opt-Out: You may opt out of SMS communications at any time by replying STOP to any message or by contacting us directly. You may also opt out of specific message categories while remaining subscribed to others.

12.6 Carrier Limitations: SMS services are available for major U.S. carriers. We are not responsible for messages that are delayed, undelivered, or blocked by your mobile carrier.

12.7 Privacy: Your phone number and SMS preferences are handled in accordance with our Privacy Policy. We do not sell or share your mobile number with third parties for their marketing purposes.

12.8 Changes to SMS Services: We reserve the right to modify or discontinue SMS services at any time. We will notify active SMS subscribers of material changes.
